Information for the Traveler
The combination of travel services offered to you constitutes a package travel arrangement within the meaning of Directive (EU) 2015/2302.
Therefore you can invoke all EU rights that apply to package holidays. The van der Valk Freizeit und Touristik GmbH bears full responsibility for the proper performance of the entire package holiday.
In addition, van der Valk Freizeit und Touristik GmbH has the legally required protection for the refund of your payments and, if transport is included in the package holiday, to ensure your repatriation in the event of its insolvency.
Most important rights under Directive (EU) 2015/ 2302
The travelers receive all essential information about the package holiday before concluding the package travel contract.
At least one contractor is always liable for the proper performance of all travel services included in the contract.
Travelers are given an emergency telephone number or details of a contact point through which they can contact the tour operator or the travel agency.
The travelers can transfer the package tour – within a reasonable period and, in certain cases, at additional cost – to another person.
The price of the package tour may only be increased if certain costs (for example fuel prices) increase and if this is expressly provided for in the contract, and in any case no later than 20 Tage before the start of the package tour. If the price increase exceeds 8 % of the package tour price, the traveler may withdraw from the contract. If a tour operator reserves the right to increase the price, the traveler has the right to a price reduction if the corresponding costs decrease.
The travelers may withdraw from the contract without payment of a cancellation fee and receive a full refund of all payments if one of the essential components of the package tour, with the exception of the price, is substantially changed When the entrepreneur responsible for the package tour cancels the package tour before the start of the package tour, the travelers are entitled to a reimbursement of costs and, in some circumstances, to compensation.
Travelers may withdraw from the contract without payment of a cancellation fee if extraordinary circumstances occur before the start of the package holiday, for example if there are serious security problems at the destination that are likely to affect the package holiday.
In addition, travelers may withdraw from the contract at any time before the start of the package tour upon payment of an appropriate and reasonable cancellation fee.
If, after the start of the package tour, essential components of the package tour cannot be carried out as agreed, reasonable alternative arrangements must be offered to the traveler at no additional cost. The traveler may withdraw from the contract without payment of a cancellation fee (in the Federal Republic of Germany this right is called “termination”) if services are not provided in accordance with the contract and this has a significant impact on the provision of the contractual package tour services and the tour operator fails to remedy the situation.
The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or are not provided properly.
The tour operator provides assistance to the traveler when they are in difficulty.
In the event of the insolvency of van der Valk Freizeit und Touristik GmbH, payments will be refunded. If the insolvency of van der Valk Freizeit und Touristik GmbH occurs after the start of the package tour and transport is part of the package tour, the return transport of the travelers will be guaranteed. Van der Valk Freizeit und Touristik GmbH has concluded insolvency coverage with R+V Allgemeine Versicherung. Travelers can contact R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, +49 611 533-5859, if services are denied to them due to the insolvency of van der Valk Freizeit und Touristik GmbH.
